Is the manufacturer of a plant/machine obliged to supply the risk assessment to his customers?

In accordance with the Machinery Directive 2006/42/EC, each plant/machine manufacturer is obliged to produce a risk assessment in accordance with Annex I of the MD. The risk assessment is part of the mechanical documentation of any plant/machine, and also of partly completed machinery under the terms of the MD. Technical documents must always be held in readiness by the manufacturer, so that they can be presented to the relevant authorities in timely manner on demand.


However, the risk assessment is not included in the technical documentation supplied by the machine manufacturer. Supply of the risk assessment can and should be agreed as part of the contract.
