Occupational Health and Safety Act

In addition to providing safe work equipment, each employer is also obliged to provide a safe workplace for his staff. In Germany, the framework conditions for the workplace are regulated by the Occupational Health and Safety Act. Many other European countries also have domestic laws that are concerned with the same issue.

Obligations of the employer in accordance with the Occupational Health and Safety Act

The German Occupational Health and Safety Act stipulates that a hazard assessment must be made in every workplace to check for possible defects. Corresponding safety measures must be derived from this assessment. The Act also stipulates that staff must receive training from their employer at regular intervals.

 

Obligations of the employee in accordance with the Occupational Health and Safety Act

In turn it is the obligation of the employee to comply with the employer's health and safety work instructions. Hazards, risk and safety-related defects must be reported to the employer.
