When the manufacturer needs spare parts for an older machine, must these spare parts meet the requirements of the current Machinery Directive?

When servicing his plant and machinery the employer must comply with the applicable health and safety regulations (in particular the industrial safety regulations – BetrSichV). This may have implications for the purchase of spare parts.

Spare parts are like any other product: the regulations applicable at the time they are placed on the market must be taken into account. However, not all spare parts for plant and machinery fall under the scope of the Machinery Directive. The Product Safety Act (ProdSG) applies for these products.
